Intellectual Property
All content published and made available on our Site is the property of THINK eLearn Inc. and the Site's creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.
Acceptable Use
As a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:
- Violate the intellectual property rights of the Site owners or any third party to the Site.
If we believe you are using our Site illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to our Site. We also reserve the right to take any legal steps necessary to prevent you from accessing our Site.
Course Enrollment and Payment
Pricing Types
Courses on our Site may be offered under the following pricing models:
- Free: No payment required. Enrollment is activated immediately upon registration.
- Fixed-Price: A set price in Canadian Dollars (CAD) is required for enrollment.
- Pay-What-You-Can: You choose your payment amount within a minimum and maximum range displayed on the course page.
Payment Processing
All payments are processed securely through Stripe, a third-party payment processor. We do not store your credit card information on our servers. By making a payment, you agree to Stripe's terms of service and privacy policy.
Enrollment Activation
For paid courses:
- Your enrollment will be in "Pending Payment" status until payment is successfully processed.
- Upon successful payment, your enrollment status will change to "Active" and you will receive immediate access to course content.
- If payment fails, your enrollment will be marked as "Payment Failed" and you may attempt to complete payment again.
Free courses and pay-what-you-can courses with a $0 amount will activate immediately without payment processing.
Account Creation
OAuth-Only: Sign up with Google or Microsoft (no passwords stored).
- Children Under 13: Must use Google Family Link or Microsoft Family Safety (parent-managed accounts with parental consent already obtained)
- Ages 13+: Use standard Google/Microsoft accounts

Enrollment Limits
Some courses may have enrollment limits. Once a course reaches its maximum enrollment capacity, new enrollments will not be accepted until spaces become available. Enrollment limits are displayed on each course page where applicable.
Prerequisites
Certain courses may require completion of prerequisite courses before enrollment. You must complete all required prerequisites before enrolling in advanced courses. Prerequisite requirements are clearly displayed on each course page.
Cancellation and Refunds
Refund Policy
We offer a refund window for paid course enrollments to ensure your satisfaction. The standard refund window is 30 days from the date of purchase, though some courses may have different refund windows as specified on the course page at the time of enrollment.
How to Request a Refund
To request a refund within the applicable refund window:
- Log in to your student dashboard at /dashboard/
- Navigate to the course you wish to refund
- Click the "Request Refund" button (available only within the refund window)
- Optionally provide feedback about your reason for the refund
Refunds are processed automatically and typically appear in your original payment method within 5-10 business days, depending on your financial institution.
Partial Refunds
Partial refunds may be issued at our discretion in special circumstances. Please contact us at support@thinkelearn.com to discuss your situation.
Course Access After Refund
Upon processing a refund:
- Your enrollment status will change to "Refunded"
- You will immediately lose access to all course content and materials
- Your course progress and completion records will be archived but not deleted
- You may re-enroll in the course at any time by making a new purchase
Non-Refundable Circumstances
Refunds will not be provided in the following circumstances:
- Requests made after the refund window has expired
- Free course enrollments (no payment was made)
- Cases where the user has violated these Terms and Conditions
Cancellation by THINK eLearn
We reserve the right to cancel course enrollments and issue full refunds in the following cases:
- A course is discontinued or removed from our platform
- Technical issues prevent course delivery
- An enrollment was created due to a system error or fraudulent activity
In such cases, you will receive a full refund regardless of when the cancellation occurs, and you will be notified via email.
Course Access and Content
Access Duration
Once enrolled in a course with an "Active" status, you have unlimited access to the course content for as long as your enrollment remains active. We do not currently impose time limits on course access, though we reserve the right to modify this policy with advance notice.
Course Content License
All course content, including but not limited to SCORM packages, videos, documents, assessments, and educational materials, is licensed to you for personal, non-commercial use only. You may not:
- Share, distribute, or republish course content
- Download or extract course materials for use outside our platform
- Use course content for commercial purposes
- Attempt to circumvent content protection or security measures
Course Updates and Modifications
Course instructors and THINK eLearn Inc. reserve the right to update, modify, or improve course content at any time. Enrolled students will have access to updated content at no additional cost. We may also retire or discontinue courses, in which case enrolled students will be notified in advance.
Student Conduct
As a student enrolled in our courses, you agree to:
- Use course materials solely for educational purposes
- Not engage in cheating, plagiarism, or academic dishonesty
- Respect the intellectual property rights of instructors and content creators
- Interact respectfully with instructors and other students
Violation of student conduct policies may result in enrollment cancellation without refund and suspension from the platform.
Limitation of Liability
THINK eLearn Inc. and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.
Indemnity
Except where prohibited by law, by using this Site you indemnify and hold harmless THINK eLearn Inc. and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.
Applicable Law
These Terms and Conditions are governed by the laws of the Province of Ontario.
Severability
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.
Changes
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.
